State’s attorneys file motion to correct 90 typos, citation errors in brief

On March 26, 2014, Gene Schaerr, Utah’s lead counsel in the Kitchen v. Herbert case, filed a motion with the Tenth Circuit Court of Appeals requesting “leave to file corrected reply brief.” The motion seeks to correct over 90 typographical, spelling, and citation errors made in the initial reply brief.

The plaintiffs attorneys did not oppose the motion.

The State of Utah is paying Schaerr up to $200,000 for this phase of the proceedings.
